Welcome to Everwysh.com. These Terms of Service (“Terms,” “ToS,” or “Agreement”) are a legally binding agreement between you (“User,” “Client,” or “You”) and Everwysh LLC, a Nevada Limited Liability Company (“Company,” “Everwysh,” “we,” us,” or “our”).

By accessing our website, purchasing products, or participating in our Masterclasses, Courses, or Mentoring sessions (collectively, the “Offerings”), you agree to be bound by these Terms.

1. EDUCATIONAL DISCLOSURE & MEDICAL DISCLAIMER (IMPORTANT)

Dr. Wendy Lafever Jordanov holds a PhD in Educational Psychology and Research. She is an educator and researcher; she is NOT a licensed clinical psychologist, medical doctor, or mental health counselor.

  • Educational and Inspirational Purpose Only: All content, materials, and sessions provided by Everwysh LLC are for educational, informational, and inspirational purposes only. The information provided is intended to share research-based wellness practices and psychological principles of well-being.

  • No Therapy or Treatment: Participation in any Offering does not constitute mental health treatment, psychotherapy, or medical advice. Everwysh LLC does not diagnose or treat mental health disorders.

  • No Professional-Patient Relationship: Your use of this website, or your participation in any Masterclass, Course, or Mentoring session, does not create a therapist-patient or doctor-patient relationship.

  • Consult Your Healthcare Provider: You should not rely on the information provided by Everwysh LLC as a substitute for help from a licensed medical or mental health professional. Always seek the advice of your physician or qualified health provider regarding any physical or mental health condition. Do not disregard professional medical advice or delay seeking it because of something you have read on this website.

  • Emergency Disclaimer: If you are experiencing a mental health emergency or crisis, please call 988 (in the USA) or visit the nearest emergency room. Everwysh LLC does not provide crisis intervention services.

2. GENERAL PROVISIONS

  • Eligibility: You must be at least 18 years of age to purchase any Offerings.

  • Modifications: We reserve the right to update these Terms at any time. Your continued use of the site following the posting of changes constitutes acceptance of those changes.

  • Pricing: All prices are in USD. You are responsible for any applicable sales tax based on your location.

3. SPECIFIC OFFERING TERMS

A. Defying Gravity in Midlife Live Masterclass

  • Delivery: Digital materials (Questionnaires, Worksheets, Action Plan) are delivered via email. The session is conducted live via Zoom.

  • Cancellations and Refund Policy: We understand that plans change and we’ve made it super easy for you to cancel your registration, if you need to - simply follow the link in the original confirmation email you received from us. You can cancel your registration online instantly - no need to email or call us. Please note that to get a refund, you must cancel your registration at least 24 hours in advance. No-shows or cancellations within 24 hours forfeit the registration fee.

B. 10-Day Defying Gravity Online Course

  • Lifetime Access: Access is granted via member login on Everwysh.com. “Lifetime Access" is defined as the period during which Everwysh LLC continues to operate the 10-Day Online Course and Everwysh.com remains active. Should the Company choose to discontinue the course or website in the future, we will make every effort to provide clients with at least 30 days' notice via the email on file so you may download any available course resources.

  • Refund Policy: Refunds are available within 7 days of purchase and only if less than 20% of the course content has been accessed.

  • Personal Use Only: You alone, as the purchaser of the Course, are given access to the course and its materials. You may not copy, share, distribute, or use the course materials with others. You may not share access to the course with others. Doing so is a breach of these Terms and will result in immediate termination of access to the Course.

  • Responsibility: Results depend on individual implementation. We do not guarantee specific outcomes.

C. One-on-One Mentoring Sessions

  • Scope: This is a one-hour educational mentoring session focused on life-design and wellness habits. It is not psychological counseling.

  • Cancellations and Refund Policy: We understand that plans change and we’ve made it super easy for you to cancel or reschedule your session, if you need to - simply follow the link in the original confirmation email you received from us. You can cancel your registration online instantly - no need to email or call us. Please note that to get a refund, you must cancel your registration at least 24 hours in advance. No-shows or cancellations within 24 hours forfeit the registration fee.

  • Book Delivery: This offering includes a digital copy of the book Defying Gravity. Upon booking, the Client may choose between (1) a Kindle code (subject to availability in the Client’s Amazon marketplace country) or (2) a PDF version. No physical copies will be mailed.

4. INTELLECTUAL PROPERTY

All content on Everwysh.com, including but not limited to videos, workbooks, text, graphics, and the book Defying Gravity, is the exclusive property of Everwysh LLC.

  • Limited License: You are granted a single-user, non-transferable license to use materials for personal growth.

  • Prohibited Acts: You may not record sessions, copy, redistribute, or sell any of our proprietary materials.

5. LIMITATION OF LIABILITY & INDEMNIFICATION

To the maximum extent permitted by law, Everwysh LLC and Dr. Wendy Lafever Jordanov shall not be liable for any direct, indirect, or consequential damages resulting from your participation in the Offerings. You agree to indemnify Everwysh LLC against any claims arising from your use of the site.

6. DISPUTE RESOLUTION & GOVERNING LAW

  • Governing Law: These Terms are governed by the laws of the State of Nevada.

  • Venue: Any legal action or arbitration shall take place exclusively in Reno, Nevada.
